The Tribunal has declared senator Ademola Adeleke the winner of the governorship election held last year september in Osun state. Senator Ademola Adeleke who represented the people democratic party (PDP) contested against the sitting Governor Gboyega Oyetola of the All Progressive Congress (APC). with the later declared winner after some controversial supplementary election.
This declaration came up on Friday by the Tribunal after appealing a preliminary objection for the petition of the People Democratic Party and Senator Adeleke, thus challenging the governorship election in the state held on September 2018.
It is believed that the preliminary objection for the petition was filed by 3 defendants in the persons of All Progressives Congress (APC) and its candidate in the election, Governor Gboyega Oyetola, and also the Independent National Electoral Commission (INEC)
However of all the three defendants. claim that the petition of the People Democratic Party and its candidate Senator Ademola Adeleke was incompetent. Thus the tribunal lacked jurisdiction to hear it.
In its mandate towards Delivering a ruling on the preliminary objection, the Justice by name Justice Obiora Obi who is among the member of the three-man Tribunal held that the petition was competent.
Justice Obiora Obi also stated that the Tribunal has the jurisdiction to hear and determine it.
The judge held upheld the appeal filed by the PDP and Senator Adeleke, on grounds of merit stating that the earlier declaration and pronouncement return of Governor Oyetola by Independent National Electoral Commission was null and void.
He, thereafter, declared Senator Ademola Adeleke, who represents Osun West district in the National Assembly, as the winner of the election. On the ground that he is the duly elected governor of Osun state.
The tribunal in their final verdict said that the Certificate of Return issued to Governor Oyetola to be withdrawn and a fresh Certificate of Return should be issued to Senator Ademola Adeleke of the People Democratic Party, on the grounds that he have fulfilled the conditions of the law.
It is believed the petitioner scored the legal-verified majority of the votes during the governorship election in the state while the much controversial rerun held in the seven cancelled units were null and void and of no electoral effect.
The mandate of the People Democratic Party and Senator Ademola Adeleke approached the Tribunal to look into the declaration of Adegboyega Oyetola of the All Progressive Congress as the winner of the September 22, 2018, election conducted by the electoral body.
After declaring its final arguments and adoption of written addresses by the lawyers to the parties involved on March 7, the Tribunal however said it would reserve a clear judgment on the matter.
The Tribunal, which had earlier sat in Osun state, was relocated from the High Court of Justice Complex, in Osogbo to Abuja in November 2018.
